Judgment
Court No. - 46 Case :- CRIMINAL MISC. WRIT PETITION No. - 18531 of 2023 Petitioner :- Hariom And 7 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Vijay Babu Counsel for Respondent :- G.A.,Bindeshwari Prasad Mishra Hon'ble Ashwani Kumar Mishra,J. Hon'ble Syed Aftab Husain Rizvi,J. Prayer made to quash the First Information Report in Case Crime No.726 of 2023, under Sections 147, 148, 149, 323, 307, 452, 504, 506 I.P.C. Police Station-Kotwali, District-Mathura, cannot be entertained, as the F.I.R. contains specific allegation with regard to causing of injuries and other offences committed against the informant by the accused persons. Though injury report is not placed on record, but the counsel for the informant has produced before us the medico legal examination report of injured person in order to show that various injuries have been caused to the informant. Petitioners' contention that there exists civil dispute, can hardly be a ground for the First Information Report to quash when several persons are shown to have sustained injuries in an incident alleged in the F.I.R. As Prima-facie allegations with regard to commissioning of cognizable offence is disclosed, the prayer made to quash the F.I.R. is declined and the writ petition is dismissed.
