WRIC 40804/2023

Judgment

Court No. - 47 Case :- WRIT - C No. - 40804 of 2023 Petitioner :- Shavana Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- D.C. Dwivedi,Shashi Dhar Dwivedi Counsel for Respondent :- C.S.C. Hon'ble Manish Kumar Nigam,J.

¶1Heard learned counsel for the parties and perused the record.

¶2The present petition has been filed for the following relief: " a. Issue a writ, order or direction in the nature of mandamus commanding and directing the Respondent No. 1 (Collector Bareilly, District Bareilly) to decide the Representation dated 26-10-2023 as well as also please to pass the direction to Respondent No. 2 (Sub Divisional Magistrate, Meerganj, District Bareilly) to decide the Representation dated 24-10-2023. b. Issue a writ, order or direction in the nature of mandamus commanding and directing the Respondent No. 1 and 2 passed the direction for restraining the Respondent No. 4 to 6 from interfering into the peaceful possession of the petitioner on land in question Plot No. 2462."

¶3Contention of learned counsel for the petitioner is that an interim order has been granted by this Court in Writ B No. 1081 of 2023 directing the parties to maintain status quo, which has been violated by respondent no. 4 and therefore, a contempt petition has been filed and notices have been issued. It has been further contended by learned counsel for the petitioner that private respondents are still interfering and therefore, petitioner has moved a representation before the respondent no. 2 and same may be directed to decide.

¶4I am not inclined to interfere in the matter, since the contempt court is seized with the matter and if the petitioner has any grievance, he may file an appropriate application in the contempt court.

¶5With these observations, the writ petition is disposed of. Order Date :- 4.12.2023 Nitika Sri. (Manish Kumar Nigam, J.) High Court of Judicature at Allahabad
