¶1Heard learned counsel for the petitioner, Mr. Mridul Kumar, learned Standing Counsel for the State-respondents and Mr. Hari Narayan Singh, learned counsel for the respondent-Land Management Committee.

¶2In compliance of the order of this Court dated 7.11.2023, instruction dated 27.11.2023 is placed before the Court, which is taken on record.

¶3Mr. Mridul Kumar, learned Standing Counsel on the basis of instruction dated 27.11.2023 submitted that plot no.794 area 3.3290 hectare is recorded in different khatas. He further submitted that in respect to plot no.794Gha area 0.221 hectare, proceedings under Section 67 (1) of U.P. Revenue Code, 2006 have been registered against the persons who are in possession over the same. The particular of the cases are as follows: "i. T202303400403385 of 2023 (Gram Sabha vs. Kartar Singh) ii. T202303400403389 of 2023 (Gram Sabha vs. Deshraj Singh). iii. T202303400403386 of 2023 (Gram Sabha vs. Radheshyam). iv. T202303400403388 of 2023 (Gram Sabha vs. Krishna Avatar). v. T202303400403390 of 2023.(Gram Sabha vs. Srikant and others). vi. T202303400403394 of 2023 (Gram Sabha vs. Neeraj). vii. T202303400403387 of 2023 (Gram Sabha vs. Anil). viii. T202303400403392 of 2023 (Gram Sabha vs. Vinod Sharma). ix. T202303400403391 of 2023 (Gram Sabha vs. Santosh Diwakar). x. T202303400403395 of 2023 (Gram Sabha vs. Santosh)."

¶4In view of the registration of aforementioned cases under Section 67

(1) of U.P. Revenue Code, 2006 in respect to plot no.794 Gha, the instant public interest litigation is finally disposed of directing respondent no.4 i.e. Tahsildar, Tahsil-Akbarpur, District-Kanpur Dehat to decide the aforementioned ten cases, under Section 67 (1) of U.P. Revenue Code, 2006 in accordance with law after affording proper opportunity of hearing to both parties, expeditiously preferably within a period of six months from the date of production of certified copy of this order before him.
