Applicants being accused have approached this Court through this application under Section 482 Code of Criminal Procedure seeking quashing of the impugned order dated 23.12.2022 passed by Additional Chief Judicial Magistrate, Court No.2 Gorakhpur in Complaint Case No. 221 of 2004, titled Alka Rani Vs. Rajesh Agrawal and others, under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/5 Dowry Prohibition Act, 1961, whereby, their application seeking discharge was dismissed. During the course of hearing, it is fairly stated by learned counsel that during the pendency of this application, trial court has framed the charges against the applicants vide order dated 24.11.2023. In view of this, the present application laying challenge to the impugned order dated 23.12.2022, whereby, the application of the accused-applicants seeking discharge was dismissed and the order declining them exemption from personal appearance for the purposes of charge is rendered infractuous.
