¶1Heard Counsel for the petitioner, Mr. Abhinav Ojha, learned Standing Counsel for the State-respondents and Mr. Sudhir Bharti for respondent no.5, Land Management Committee.

¶2The instant public interest litigation has been filed for mandamus directing the respondent no.4, Tehsildar, Tehsil Hata, District Kushinagar to decide the case Nos.T202205440205834,

¶3Mr. Abhinav Ojha, learned Standing Counsel for the State-respondents on the basis of the instruction dated

4.11.2023 submitted that 14 cases are pending in respect to plot No. 183M area 0.717 hectare which is recorded as rasta in the revenue record. The particular of the case numbers are as follows:-

¶4In view of the pendency of the cases as mentioned above, the instant public interest litigation is finally disposed of directing the respondent no.4, Tehsildar, Tehsil Hata, District Kushinagar to decide the aforementioned cases according to the provisions contained under the U.P. Revenue Code, 2006 as well as the rules framed thereunder after affording proper opportunity of hearing to the parties in accordance with law.
