¶1The instant petition has been filed for mandamus directing the respondent no.3, Sub Divisional Magistrate Dhangata, District Sant Kabir Nagar to publish the advertisement of fisheries lease as well as direct the respondent no.3 to grant fisheries lease in favour of petitioner in respect to Arazi No. 111 kha area 0.6000 hectare.

¶2Mr. Pankaj Kumar Gupta, Counsel for respondent no.5, Land Management Committee has placed the instruction dated 7.11.2023 before the Court which is taken on record.

¶3Mr. Pankaj Kumar Gupta, Counsel for respondent no.5, Land Management Committee submitted that full procedure has been prescribed under U.P. Revenue Code, 2006 and rules framed thereunder for grant of fisheries lease, as such, petitioner is not entitled to the relief claimed in the writ petition.

¶4Considering the entire facts and circumstances as well as provisions contained under U.P. Revenue Code, 2006 and rules framed thereunder, the prayer made in the writ petition cannot be granted.
