This application u/s 482 Code of Criminal Procedure has been filed by the accused-applicant for quashing the order dated 31.10.2023 passed by Additional Sessions Judge, court no.5, Varanasi in Sessions Trial No.1349 of 2022, titled State vs. Mahendra Sonkar and others arising out of N.C.R. No.202 of 2012, under Sections 323, 504, 506 I.P.C., Police Station Badagaon, District Varanasi. When confronted with the maintainability of the petition challenging the order passed by the trial court under Section 216 Code of Criminal Procedure altering the charge, as the impugned order is revisable, learned counsel for the applicant prays for withdrawal of this petition to avail the alternative statutory remedy.
