¶1Heard learned counsel for the applicant and learned AGA for the State.
¶2The present 482 Cr.P.C. application has been filed to expedite the Criminal Case No.1358 of 2021 arising out of Case Crime No.162 of 2021, under Sections 323, 325, 504 I.P.C., PS Maharajganj, District Jaunpur, pending in the Court of Judicial Magistrate-I, Jaunpur.
¶3Learned counsel for the applicant has filed this Application u/s 482 Cr.P.C. to expedite the proceeding of Criminal Case No.1398 of 2021 and averred that charge-sheet has been submitted on 01.12.2021. Thereafter cognizance has been taken against the accused persons but accused persons have not appeared and non-bailable warrant has been issued against him. Charge-sheet has not been framed till today. There is more than two years have been passed.
¶4Learned A.G.A. has vehemently opposed the contention raised by learned counsel for the applicant.
¶5Considered the arguments raised by learned counsel for the applicant and perused the entire records. From the order-sheet, which is annexed with the application, it appears that Court is taking appropriate steps to summon the accused and bailable warrant has been issued and from the record it also appears discharge application is pending for disposal.
¶6Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide discharge application in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of three months from the date of production of a certified copy of this order, if there is no other legal impediment.
