Sri Anubhav Singh, learned Advocate holding brief of Sri Archit Mehrotra, learned counsel for the respondents states that as per the technical report obtained from the laboratory, petitioner's thumb impression and signature have not been found to be matching one. Instructions in above regard placed before this Court by learned counsel for the respondents, are taken on record. Now, since laboratory report/ technical opinion has been obtained against the petitioner, it would be more appropriate that before cancellation of a candidature of petitioner, the matter be considered in the light of the judgment of this Court in the case of Ran Vijay Singh and 34 others v. Union of India and others passed in Writ - A No.- 2813 of 2017 which has been affirmed in appeal by a Division Bench of this Court in the case of Vijay Pal and others v. Union of India and others, 2023 LawSuit (All) 762 and in the event candidature has been cancelled without affording an opportunity, such an order if passed shall remain in abeyance and shall abide by the decision to be taken by the authority as directed hereinabove.
