¶1Heard learned counsel for the petitioners and perused the record.

¶2It is argued by learned counsel for the petitioners that along with the Original Suit No.3580 of 2023 (Munna Lal Vs. Nokhe Lal), an application for grant of interim protection was filed on 22.09.2023, copy of which is appended at page 28 of the paper book. It is argued that since there is no partition taken place of the property in dispute but the respondents are trying to create third party right.

¶3Heard learned counsel for the petitioner and perused the record.

¶4It reveals from perusal of the record that though the injunction application has been file din the aforesaid suit on 22.09.2023 but till date no decision has been taken place.

¶5In the facts and circumstances of the case, the present petition is disposed of directing the court concerned to decide the aforesaid injunction application, if possible, on the next date fixed in the matter. If on account of any reason, the same could not be decided, the aforesaid application be decided within a period of six weeks but without granting any unnecessary adjournment to any of the parties, if there is no legal impediment.

¶6Till 31st January, 2024 or till decision taken on the injunction application, whichever is earlier, parties are directed to maintain status quo. Order Date :- 5.12.2023/saqlain High Court of Judicature at Allahabad
