Judgment

Court No. - 6 Case :- WRIT - C No. - 38890 of 2023 Petitioner :- Neelam Singh Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Agnihotri Kumar Tripathi Counsel for Respondent :- C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Agnihotri Kumar Tripathi, learned counsel for the petitioner and learned Standing Counsel for the State-respondent. The writ petition has been filed by the petitioner with the prayer to direct the respondent no.2 to take the action on the application filed by the petitioner under Section 95(1)(G) of U.P. Panchayati Raj Act, 1947 and a further prayer to direct the respondent no.4 for lodging an F.I.R. against the respondent no.6 and 7 under Section 95(1)(G) of U.P. Panchayati Raj Act, 1947. Learned counsel for the petitioner submits that petitioner is a complainant who has filed complaint against the Gram Pradhan but no decision has been taken till date on the complaint filed by the petitioner-complainant. Learned Standing Counsel submits that being complainant-petitioner has no locus to file such petition, therefore, this petition is not maintainable. In support of his contention, he has relied upon the Full Bench judgment of this Court in the case of Vivekanand Yadav vs. State of U.P. and another reported in 2010(10) ADJ 1 (FB). Accordingly, the petition is misconceived and is dismissed. Order Date :- 5.12.2023 Kalp Nath Singh High Court of Judicature at Allahabad
