Court No. - 68 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 51953 of 2023 Applicant :- Mohammad Saddam Opposite Party :- State of U.P. Counsel for Applicant :- Ashish Pandey,Satya Prakash Rathor Counsel for Opposite Party :- G.A. Hon'ble Dr. Gautam Chowdhary,J.
¶1Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.
¶2The prosecution story in brief is that the on 12.09.2023, the victim was going to market. on the way, the applicant was tracking her behind and was insisting her to talk him, failing which, he would inform about her to her matrimonial house, thereafter he asked as to where she was going, which was replied by her to hospital, thus the applicant had put pressure to drop her to hospital, on threatening the victim had had gone with her but the applicant instead of taking her to hospital took her to Basoran Mohalla and had threatened her to talk her.
¶3Learned counsel for the applicant submits that initially F.I.R. was registered under Section 354 (Gha), 506 I.P.C. and that the victim in her statement recorded under Section 161 Cr.P.C. has specifically answered "No" to the question as to whether the applicant has committed wrong with her but in her statement recorded under Section 164 Cr.P.C. the victim has levelled allegation of rape against the applicant. It is thus contended that there are contradiction in the statements of the victim recorded under Section 161 and 164 Cr.P.C. Learned counsel further submits that the victim is major and in the medical legal examination report, the doctor opined that there are no sign of sexual violence. Learned counsel further submits that the applicant has been falsely roped in the instant case due to village parti bandi and that no offence has been committed by the applicant. It is thus contended that the applicant is entitled for bail. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned. It has also been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required and is also ready to accept all the conditions which the Court may deem fit to impose upon him. He next submits that applicant is languishing in jail since 16.09.2022 having no criminal history.
¶4Per contra, learned A.G.A. has opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged at pre trial stage, therefore, he does not deserve any indulgence. In case the applicant is released on bail he will again indulge in similar activities and will misuse the liberty of bail.
¶5Considering the entire facts and circumstances of the case, submissions of learned counsel for the parties, nature of evidence, and all attending facts and circumstances of the case, without expressing any opinion on merits of the case, this Court is of the view that the applicant has made out a case for bail. Hence the bail application is allowed.
