¶1Heard Shri Rateesh Singh, learned counsel for the petitioner, Shri P. K. Pandey, learned Additional Chief Standing Counsel for the State-respondent and Sri Alok Misra, learned Counsel for respondent nos. 2 to 5.

¶2The present writ petition is preferred for a direction commanding respondent to restore to the electricity connection of the petitioner within a stipulated time and also provide the reassessment amount, if any.

¶3Sri Alok Mishra, learned counsel for the contesting respondents raised an objection regarding maintainability of the writ petition on the ground that earlier the petitioner had preferred Writ-C No. 14913 of 2021 (Smt. Prema Devi v. State of U.P. and Others). The said writ petition was disposed of by the Division Bench vide order dated 29.7.2021 with detailed observations. He submits that even though the reprieve was accorded to the petitioner but the terms and conditions have not been complied. Therefore, for the same cause of action, the second writ petition is not maintainable.

¶4Confronted with the situation, learned counsel for the petitioner states that he is not inclined to press the writ petition. However, leave may be accorded to press the relief in the aforementioned writ petition for enlargement of time.

¶5Consequently, the writ petition stands disposed of in terms of the aforesaid leave. Order Date :- 5.12.2023 Vijay High Court of Judicature at Allahabad
