Judgment

Court No. - 34 Case :- WRIT - A No. - 20145 of 2023 Petitioner :- Seema Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Siddharth Khare,Sr. Advocate Counsel for Respondent :- CSC Hon'ble Ajit Kumar,J. Petitioner is aggrieved by the transfer order dated 21st November, 2023 from district Meerut to Aligarh circle and that too from intelligence department to civil police. Learned counsel for the petitioner submits that petitioner is a single person who has been transferred from intelligence department to civil police even though 118 persons of her batch have been retained in intelligence department. He further submits transfer order in mid-academic sessions is not equitable one and, therefore, respondents ought to have waited for the next academic session. There are certain more allegations made in paragraph 23 of the writ petition. Per contra, it is argued by learned Additional Chief Standing Counsel that petitioner having already been relieved on 23rd November, 2023, should be asked to join first at the transferred place before she prefers representation. Be that as it may, since petitioner has been admittedly transferred in the mid-academic sessions while her daughter is studying, I find it more appropriate for her to make representation before the authority concerned, namely, respondent No.- 2 within a period of two weeks from today, the same shall be considered and disposed of by the respondent No.- 2 within a next two weeks' time. For the period of 30 days or until such decision is taken, whichever is earlier, no action shall be taken against her pursuant to the transfer order and relieving order in question. With the aforesaid observations and directions, this petition stands disposed of. Order Date :- 5.12.2023 Atmesh High Court of Judicature at Allahabad
