Judgment
Court No. - 93 Case :- APPLICATION U/S 482 No. - 44348 of 2023 Applicant :- Shakil Ahmad Opposite Party :- State of U.P. and Another Counsel for Applicant :- Dharmendra Pratap Singh Counsel for Opposite Party :- G.A. Hon'ble Manoj Bajaj,J. Applicant being accused has approached this Court through this application under Section 482 Code of Criminal Procedure seeking quashing of the order dated 06.10.2023 issuing non-bailable warrants against him as well as subsequent orders passed by Additional Sessions Judge/F.T.C., Fatehpur in Sessions Trial No.240 of 2021, titled State Vs. Shakil, arising out of case crime no.102 of 2018, under Sections 307, 504, 506 I.P.C., Police Station-Bindki, District-Fatehpur. Learned counsel fairly states that the applicant was arraigned as an additional accused by the trial court by exercising power under Section 319 Code of Criminal Procedure and the said order was challenged by him before this Court through Criminal Revision No.1563 of 2021 which is pending adjudication. He fairly states that in the revision petition no interim relief much less staying the proceedings or exempting his appearance before the trial court was granted by this Court. When confronted with the maintainability of this petition, challenging the issuance of non-bailable warrants by the trial court to secure the presence of the applicant, learned counsel does not press this application in order to press his claim in the pending revision petition. Dismissed as withdrawn. Order Date :- 5.12.2023 Raj High Court of Judicature at Allahabad
