¶1Heard learned counsel for the petitioner and learned Additional Chief Standing Counsel for the State.

¶2The instant petition has been filed for mandamus directing the respondent no. 2/Naib Tehsildar, Tehsil Jungle Kauriya, District Gorakhpur to decide the Case No. 127/2578 and Computer Case No. T201905310328663 (Urmila Devi Vs. Mubarak Husain), within stipulated period.

¶3Instruction dated 1.12.2023 has been sent by Naib Tehsildar, Sadar Gorakhpur annexing the certified copy of the order dated

16.11.2023 passed by Naib Tehsildar rejecting the restoration application dated 2.6.2011 as not maintainable as well as on the ground of limitation.

¶4In view of the order dated 16.11.2023 passed by the Naib Tehsildar, no further cause of action survives in the matter.
