¶1The petitioner who claims to be a Member of Gram Panchayat, had made certain complaints against the sitting Gram Pradhan, Vinay Kumar Pathak (respondent no. 9) regarding misuse of public funds.

¶2The prayer made in the instant petition is for a direction to the respondent authorities to hold enquiry against respondent no. 9 and take action against him.

¶3Under the U.P. Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997, a wholesome procedure is prescribed for filing complaints and for enquiry, etc. Therefore, we find no good ground to entertain a public interest litigation in this behalf. It is left open to the petitioner to take recourse to the procedure provided under law.

¶4The petition stands disposed of accordingly.
