¶1Heard learned counsel for the parties and perused the record.
¶2The instant writ petition has been filed seeking following relief :- "i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to make the boundary (mendbandi) over the gata no. 384ka area 0.457 hectare 439 area 0.331 hectare and 385 area 0.2850 hectare situated at village Beerapur Kasodhan post office Baraut Pargana Kewai Tehsil Handia District Prayagraj by way of providing the police force.
ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no. 6 to 10 not to interfere in peaceful possession of the petitioner over the gata no. 378, 360, 38, 384ka, 439, 385 situated at Village Beerapur Kasodhan post office Baraut Pargana Kewai Tehsil Handia District Prayagraj."
¶3Learned counsel for the petitioner submitted that petitioner has moved an application u/s 23 of the U.P. Revenue Code, 2006 on 2.12.2023. He prayed that the same may be decided expeditiously.
¶4No useful purpose would be served in keeping this petition pending.
¶5Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of that in case such an application is filed by the petitioner, the same will be considered and decided by the respondents' authorities, in accordance with law, expeditiously, preferably within a period of two months from the date of production of a certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided there is no other legal impediment.
