¶1Heard learned counsel for the parties and perused the record.

¶2The instant petition has been filed seeking following relief :- "a writ, order or direction in the nature of Mandamus commanding/directing to the respondent no.2 (Sub Divisional Officer, Tehsil Sadar District Farrukhabad) to make boundary marks to be erected, restored, repaired or replace the gata no.373 area about 0.1210 hect. in situated Village Nagla Malu, Pargana - Shamsabad Purva, Tehsil Sadar, District Farrukhabad."

¶3Contention of learned counsel for the petitioners is that boundary marks which were installed have been demolished by respondent Nos.2 to 9 and in this regard he has moved an application before the S.D.M. concerned. He prayed that the same may be decided expeditiously.

¶4No useful purpose would be served in keeping this writ petition pending.

¶5In view of the above, this writ petition is finally disposed of with a direction that in case, such an application is moved by the petitioners, the same may be treated to have been moved u/s 23 of the U.P. Revenue Code, 2006 and be decided, in accordance with law, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order after providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
