¶1Heard learned Counsel appearing for the petitioner, learned Standing Counsel appearing for Respondents No.1 and 2 as well as Sri Arun Kumar, learned counsel appearing for Respondents No. 3 and 4.

¶2Petitioner, though this writ petition, has challenged the orders dated 2.5.2023 and 25.8.2023 passed by the District Basic Education Officer, Kanpur Nagar, whereby petitioner has been directed to take charge of the post of Headmaster of Primary School, Usmanpur Ghatampur, District Kanpur Nagar.

¶3Learned Counsel appearing for the petitioner, after arguing at some length, has confined his prayer that since petitioner is ready to take charge of the post of Headmaster of Primary School, Usmanpur Ghatampur, District Kanpur Nagar, therefore, direction may be issued to District Basic Education Officer, Kanpur Nagar to allow him to join as incharge Headmaster and further petitioner's salary which has been stopped w.e.f. month September, 2023 be released.

¶4Sri Arun Kumar, learned counsel appearing for Respondents No. 3 and 4 has submitted that once petitioner is ready to take over charge of the post of Headmaster of Primary School, Usmanpur Ghatampur, District Kanpur Nagar, there is no difficulty with the District Basic Education Officer, Kanpur Nagar in releasing petitioner's salary, in accordance with law.

¶5Considering the facts and circumstances of the case, without adverting to merits of the case and on consent, this writ petition is finally disposed of with liberty to petitioner to move a fresh representation, within a week from the date he submits joining as Incharge Headmaster of Primary School, Usmanpur Ghatampur, District Kanpur Nagar regarding release of his salary and if petitioner joins and submits representation, the District Basic Education Officer, Kanpur Nagar shall take decision regarding release of petitioner's salary within fifteen days from the date of submission of the representation.
