¶1The present petition has been filed praying for a mandamus commanding the respondents who are officer of Purvanchal Viddut Vitran Nigam Ltd. to remove the electricity poles installed over the Bhumidhari plot of the petitioner i.e. Plot Nos. 323 and 324 plot no.21 has wrongly been transcribed in the prayer clause in place of Plot Nos. 323 and 324).

¶2It has been stated in the petition that in an identical matter the electricity poles installed over plot no. 21, a Co-ordinate Bench of this Court vide order dated 30 November, 2023 passed in Writ-C No. 36750 of 2023 has directed the District Magistrate concerned to decide the representation of the petitioner filed for this purpose.

¶3Learned counsel for Purvanchal Viddut Vitran Nigam Ltd has admitted the fact that the matter in the present petition is identical to the matter in Court in Writ-C No. 36750 of 2023.

¶4In view of the aforesaid, the present petition is disposed of in terms of the order dated 30th November, 2023 passed in Writ-C No. 36750 of 2023 with liberty to the petitioner to move an appropriate application before the concerned District Magistrate with regard to his claim alongwith certified copy of this order and other supported materials, whereupon the District Magistrate shall pass appropriate orders on the claim of the petitioner in accordance with law within three months from the date of production of a certified copy of this order.
