¶10On perusal of said section, it is clear that immediately after issuance of the notification 27.5.1999, the area/ plot in question will be the subject matter of Municipal Council, Tunda and shall be governed by the UP Municipalities Act with immediate effect.

¶11On pointed query put to the learned counsel for the respondents that once the area/plots in question have been included within the municipal limits of Municipal Council, Tundla, how the proceedings can be permitted to be initiated by respondent no. 2, they could not give any satisfactory reply of the same.

¶13Once the fact that area / plots in question have been included within the municipal limits of Municipal Council, Tundla, has not been disputed by respondent no. 2, the proceedings cannot be permitted as the same is without authority of law in pursuance of Section 5 of the UP Municipalities Act, 1916.
