¶1In pursuance to the previous order passed by this Court, the Standing Counsel has obtained instructions and on the basis of his instructions states that the police is not interfering either in the possession of the petitioner over his plot or in any manner in the substantive rights of the parties. The order dated 27.10.2023 which appears to be cause of action of the writ petition only directs the Station House Officer, Police Station Line Bazar, Jaunpur to ensure maintenance of law and order and take any preventive actions. The said order does not by itself indicate that the District Administration is interfering in the substantive rights of the parties.

¶2The petition involves disputed questions of fact which can be decided only on evidence.

¶3The petitioner has the remedy to institute appropriate proceedings before the civil court and also to seek injunction.
