¶1Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Prajnal Mehrotra, learned counsel for respondent No.4.

¶2The present writ petition has been filed with the prayer that respondent No.4 may be directed to provide an opportunity to the petitioner to pay of entire amount due to respondent No.4 within specified period in easy installments.

¶3Sri Pranjal Mehrotra, learned counsel for respondent No.4 has informed the Court that even though Rs.1,96,500/- is due from the petitioner, respondent No.4 is ready and willing to accept Rs.1,55,508/- if the petitioner deposits the said amount within one year.

¶4Under such circumstances, we provide that if the petitioner deposits 25% of the entire amount due from the petitioner within a period of one month from date, then remaining amount shall be paid by the petitioner in four equal installments within 11 months. However, in case of default in making payment, as directed above, it shall be open for respondent No.4 to recover the amount from the petitioner in accordance with law.
