¶1Heard learned counsel for the petitioner and Sri Rajmohan Upadhyay, learned Additional Chief Standing Counsel for the State-respondents.

¶2In pith and substance, the grievance of the petitioner is that at the time of filing the writ petition, the respondent Nos.2 and 3 refused to lodge First Information Report against respondent Nos.4 and 5. Learned counsel for the petitioner submits that during pendency of the writ petition, First Information Report has been lodged. He further submits that a direction may be issued to the investigating officer to conduct free and fair investigation in the matter.

¶3Considering the facts and circumstances of the case, we are not inclined to adjudicate the matter in hand. Needless to say that it is always hoped and expected from an investigating officer to investigate any matter in a free and fair manner.
