Judgment

Court No. - 47 Case :- WRIT - C No. - 41847 of 2023 Petitioner :- Raghav Narayan Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Sachchidanand Srivastava Counsel for Respondent :- C.S.C.,Pankaj Kumar Gupta Hon'ble Manish Kumar Nigam,J.

¶1Heard learned counsel for the parties and perused the record.

¶2The instant petition has been filed seeking following relief :- "i) issue a writ, order or direction in the nature of certiorari quashing the order dated 14.11.2023 (Annexure No.1) passed by Respondent no.2 in Revision/Case No. 762 of 2023, Computerized Case No. C20231700000762 (Raghav Narayan Singh vs. Smt. Chandra Kiran and others) and order dated 12.4.2021 (Annexure No.2) passed by Respondent no.3 in Case No. 00949/2021, (Chandra Kiran Vs. State) U/s 67-A of U.P. Revenue Code-2006.

iii) issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to hear and decide the Revision/Case No. 762 of 2023, Computerized Case No. C202317000000762 (Raghav Narayan Singh Vs. Smt. Chandra Kiran and others) filed by petitioner on merit."

¶3Contention of learned counsel for the petitioner is that the Revisional Court has erred in law in abating the proceedings after commencement of the Consolidation operations.

¶4In my view, there is no illegality in the order, as any question relating to the title, has to be decided by the Consolidation Courts if the Consolidation operations are going on and the Revenue Courts have no jurisdiction.

¶5In view of the same, this Court is not inclined to interfere with the matter.

¶6Accordingly, this writ petition is dismissed with liberty to the petitioner to avail the remedy, as available to him, under the law. Order Date :- 5.12.2023 Rishabh [Manish Kumar Nigam, J.] High Court of Judicature at Allahabad
