¶1The case of the petitioner is that the building plan of the petitioner's building sanctioned by Ghaziabad Development Authority, Ghaziabad on 09.08.2001, was valid for five years. She could not raise constructions on the first and second floors as per sanctioned plan within time because of various reasons. She applied on 05.07.2023 for extending the validity of building plan. As the said application has not been decided so far, the instant petition has been filed praying for a writ of mandamus directing the respondents to pass appropriate orders on the said application.

¶2Sri Ravi Prakash Pandey, learned Standing Counsel appearing for respondent nos.2 and 3 and Sri Hare Ram, learned Standing Counsel for the State-respondents have no objection in case a direction is issued for consideration of the said application.

¶3Accordingly, the instant petition is disposed of with direction to the Competent Authority - Ghaziabad Development Authority, Ghaziabad to pass appropriate order on the application of the petitioner dated 05.07.2023 within a period of four weeks from the date of communication of the instant order along with photocopy of the application dated 05.07.2023.
