¶1Case called out in revised list. Learned counsel for the petitioner & learned counsel for respondent No. 1 is present. However, Sri Ramesh Kumar Saxena, learned counsel for the Bank-respondent is not present.

¶2The present petition has been filed for the following relief: " a. Issue a writ, order or direction in the nature of MANDAMUS commanding and directing the respondents to appoint the petitioner under Dying In Harness Rules. b. Issue a writ, order or direction in the nature of MANDAMUS commanding the respondents to decide the applications/ representations of the petitioner for compassionate appointment pending before respondents."

¶3Contention of learned counsel for the petitioner is that Neeraj Singh, who was real brother of the petitioner died on 23.05.2021. Neeraj Singh was working as Assistant Manager in the Central Bank of India, Nandnagar Branch Basti at the time of his death. After the death, the petitioner moved an application on 17.08.2021 for seeking compassionate appointment. It has been further contended that despite application being moved by the petitioner, no order has been passed on the aforesaid application.

¶4No useful purpose would be served in keeping this petition pending.

¶5Let the application filed by the petitioner for appointment under the Dying In Harness be considered and decided by respondent No. 2 expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him. It is made clear that this Court has not examined the claim of the petitioner on merits.
