Judgment
Court No. - 47 Case :- WRIT - C No. - 42133 of 2023 Petitioner :- Udaiveer And Another Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Saleem Ahmad Counsel for Respondent :- CSC Hon'ble Manish Kumar Nigam,J.
¶1Heard learned counsel for the parties and perused the record.
¶2The present petition has been filed with the following prayer: "i) Issue a writ, order or direction in the nature of Mandamus directing the respondents concerned to decide/dispose of the mutation application of the petitioners dated 28.08.2023 within the short time as prescribed by this Hon'ble Court."
¶3Contention of the learned counsel for the petitioner is that the petitioner was granted lease which was subsequently cancelled against which a revision was filed by the petitioner which was allowed and the order of cancellation was set aside. It is further contended by learned counsel for the petitioner that grievance of the petitioner is that despite of order of cancellation was set aside, the name of the petitioner is not being mutated in the revenue records.
¶4Learned Standing Counsel has raised a preliminary objection that the petitioner has an alternative remedy of approaching the revenue authorities under Section 32 of the Uttar Pradesh Revenue Code, 2006 for getting the revenue records corrected.
¶5Since the petitioner has an alternative remedy, I am not inclined to entertain the instant petition.
¶6According, the writ petition is dismissed with liberty to the petitioner to avail alternative remedy as available to him under law. Order Date :- 6.12.2023 Ved Prakash (Manish Kumar Nigam, J.) High Court of Judicature at Allahabad
