¶1Heard learned counsel for the petitioner/petitioners and perused the record.

¶2The petitioners have preferred the present petition under Article 227 of the Constitution of India inter-alia with the prayer to direct the Court below to decide the Misc. Case No. 60 of 2019 (Shanti Devi and Others Vs. Girja Devi and Others) pending consideration before learned Civil Judge, (Sr. Division), Varanasi registered on an application dated 23.04.2019, moved by the respondents, under Order 9 Rule 13 of the CPC, seeking restoration of the Original Suit No. 56 of 1974 (Dhannu Ram Vs. Pancham Singh) expeditiously.

¶3It reveals from the perusal of order-sheet of the aforesaid case that in the aforesaid case itself a direction has been issued by this Court on 08.12.2022 to decide the matter expeditiously.

¶4In view of the matter, the Court is of the opinion that no relief could be granted to the petitioner.
