¶1Heard Mr. M J Akhtar, learned counsel for the applicant, learned Additional Government Advocate for the State and Mr. Vinod Kumar Singh, holding brief of Mr. Vimal Kumar Pandey, learned counsel for the informant.

¶2This anticipatory bail application (under section 438 Cr.P.C.) has been moved seeking anticipatory bail in Case Crime No.442 of 2023, under Sections 365, 342, 376-D, 506 IPC and 5 and 6 POCSO Act, Police Station Kaptanganj, District Kushinagar.

¶3During arguments, learned counsel for the applicant has submitted that a direction may be issued to the court below to decide the bail application of the applicant within a time bound period.

¶4Considering the facts and circumstances of the case, the present anticipatory bail application is disposed of with the direction that in case the applicant appears and surrenders before the court below within ten days from today and file bail application, the same shall be heard and disposed of, expeditiously, in accordance with law. For a period of ten days, no coercive action shall be taken against the applicant.
