Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Sanjay Kumar Srivastava, learned counsel for the petitioner and learned Standing Counsel for the State-respondents. At the very outset, learned Standing Counsel points out that there is an alternative remedy available of filing an appeal against order of suspension of arms license of the petitioner. Learned counsel for the petitioner submits that he will be filing the appeal within three weeks from today before the appellate authority and the shall may be decided, within stipulated period. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Considering the facts and circumstance of the case, it is permited that the petitioner shall file an appeal, ventilating all his grievances, before the respondent no.2-District Magistrate, District-Amroha, J.P. Nagar, within three weeks from today along with a certified copy of this order. In case, such an appeal is filed, the respondent no.2 shall make all endeavours to consider and decide the same, ignoring the delay, if any, in accordance with law, by means of a reasoned and speaking order, as expeditiously as possible, from the date of production of certified copy of this order, if there is no legal impediment.
