Judgment

Court No. - 40 Case :- WRIT - C No. - 41310 of 2023 Petitioner :- Prakash Singh Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Madan Singh Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Surendra Singh-I,J.

¶1Heard learned counsel for the petitioner and the learned standing counsel for the state respondents.

¶2This writ petition is preferred for a direction in the nature of certiorari to quash the order dated 18.09.2023 passed by respondent No.3 and for a direction in the nature of mandamus directing the respondent No.2 and 3 to provide U.P. Police security guard/ constable on his own expenditure. By the order impugned dated

18.09.2023, the petitioner has been informed that after consideration of petitioner's application dated 09.08.2023 in the meeting of District Level Committee dated

12.09.2023, it has been decided that security will not be provided to the petitioner under the Government Orders dated 09.05.2014 and 01.01.2016.

¶3In pith and substance, the grievance of the petitioner is that he has lawfully applied for security guard but by the order impugned dated 18.09.2023, illegally and in most arbitrary manner, respondent No.3 has denied the security guard to the petitioner without assigning any reason. He submits that there is a threat to the life of the petitioner and his family members.

¶4Learned standing counsel has raised an objection that against the order impugned, the petitioner has got efficacious remedy to approach the Regional Level Security Committee.

¶5Considering the facts and circumstances of the case, we are not inclined to keep the writ petition pending consideration as the petitioner has efficacious remedy to approach Regional Level Committee. Accordingly, writ petition is disposed of with an observation that in case petitioner approaches the Regional Level Committee for redressal of his grievance, the Regional Level Committee would consider the same as per law.
