Heard learned counsel for the petitioner. This petition has been filed seeking th following relief:- "a. Issue a order or direction to the learned Trial Court i.e. Additional Civil Judge (Junior Division), Bansi Court No.2, Siddharth Nagar to decide the case being original suit no. 127 of 1996, Gangaram Versus Shushila Devi and others, expeditiously, preferably, within some stipulated time period, pending in the court of Additional Civil Judge (Junior Division), Bansi court No.2, Siddharth Nagar." When the matter was listed on 3.10.2023, this Court had called for a report from the District Judge, Siddharth Nagar seeking the reasons as to why priority was not given for early disposal of the case. Office has put up a report dated 16.10.2023 which is on record. The District Judge has given a report which is based upon the report of the Presiding Officer of the court concerned. The report has been perused. It is reflected that the case was directed to be listed on 6.11.2023. Under the circumstances, this petition is disposed of with the direction that endeavour shall be made by the Trial Court for due consideration of the case without granting any unnecessary adjournment to either of the parties, provided there is no legal impediment.
