Court No. - 36 Case :- WRIT - A No. - 19485 of 2023 Petitioner :- C/M Adarsh Junior High School Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Awadh Narain Rai Counsel for Respondent :- C.S.C.,Sankalp Narain,Srivats Narain Hon'ble Manjive Shukla,J.

¶1Heard learned counsel appearing for the petitioner, learned Standing Counsel appearing for the Respondents No.1 to 3 and Sri H.P. Shahi, learned counsel appearing for the Respondent No.4.

¶2Petitioner through this writ petition has challenged the order dated 31.10.2023 passed by the District Basic Education Officer, Meerut, whereby order suspending services of the Respondent No.4, has been disapproved.

¶3Learned counsel appearing for the petitioner, after arguing at some length, has confined his prayer to the extent that since fresh inquiry has already been initiated against the Respondent No.4 and charge-sheet has been served on him, therefore this writ petition may be disposed of with direction to Respondent No.4 to cooperate in the disciplinary proceedings.

¶4Sri H.P. Shahi, learned counsel appearing for the Respondent No.4 has submitted that since petitioner is not pressing this writ petition against the order dated 31.10.2023 and is confining his prayer only to the extent that petitioner should cooperate in the disciplinary proceedings, he has no objection and he undertakes that Respondent No.4 will cooperate in the disciplinary proceedings.

¶5In view of the aforesaid reasons, this writ petition is finally disposed of with direction to Respondent No.4 to cooperate in the disciplinary proceedings which are being conducted by the petitioner against him. Order Date :- 7.12.2023 Salim High Court of Judicature at Allahabad
