Learned counsel for the applicant further submits that in her statement recorded under Section 161 Cr.P.C. the victim has stated that accused Panna Soni took her at the shop of accused, Kallu for a party, where she was served cold drink mixed with liquor and thereafter she was committed to rape by all the four accused persons. Learned counsel for the applicant further submits that in her statement recorded under Section 164 Cr.P.C. the victim has made allegation of rape against three persons, i.e., Kallu, Panna Soni and one unknown and she has not took the name of applicant. Learned counsel for the applicant further submits that medical evidence does not support the prosecution case. Learned counsel for the applicant further submits that F.I.R. has been lodged after a long delay of 4-5 months, there are various contradictions in the F.I.R. as well as in the statements of the victim recorded under Section 161 & 164 Cr.P.C. as well as in the statements of mother and sister of the victim, there is no recovery of alleged video and there is no evidence that the alleged video of the incident was viral, thus, applicant has falsely been implicated in the case with malicious intention. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been mentioned.
