1.Heard Mr. Puneet Bhadauria, learned counsel for the petitioner, Mr. Abhishek Shukla, learned Additional Chief Standing Counsel for the State respondents and Mr. Hari Narayan Singh, learned counsel for respondent No.5/Village Panchayat.

2.On 08.11.2023, instruction was placed before this Court by the State and order was passed by this Court to the effect that 27 cases have been registered against the persons who are found in possession over the pot Nos. 351 and 353.

¶3Learned counsel for the petitioner submitted that petitioner is not in position to pay 26 set of court fees as such he is not pressing for expeditious disposal of 27 cases within time bound period.

¶4Considering the facts and circumstances of the case, and in view of the registration of cases under Section 67 (1) of U.P. Revenue Code, 2006, no further cause of action survives in the matter and the present P.I.L.stands disposed of finally with a direction to respondent No.4/Tehsildar, Bharthana, Distrit-Etawah to consider and decide the cases under Section67 (1) of U.P. Revenue code, 2006 in accordance with law expeditiously after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
