This writ petition has been filed for quashing of the auction notice dated 20.9.2023 and the auction proceedings which were under gone 17.11.2023. Learned counsel for the Bank Ms. Sudha Pandey has submitted that the auction took place on 17.11.2023 and the auction purchaser has also been granted sale certificate. Therefore, she submits that this Court may not interfere in view of the law laid down in Celir LLP vs. Bafna Motor (Mumbai) Pvt. Ltd. & Ors. (Civil Appeal Nos. 5542 -5543 of 2023 decided on 21.9.2023). The Court does find substance in the submission of the learned counsel for the Bank. The writ petition is, accordingly, dismissed. If the petitioner, so desires, he may approach the Authorities under Section 17 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act,2002.
