Judgment
Court No. - 40 Case :- WRIT - C No. - 39704 of 2023 Petitioner :- Deepu Khatik Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Jitendra Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Surendra Singh-I,J.
¶1Heard Shri Jitendra Kumar Yadav, learned counsel for the petitioner and Shri Ambrish Shukla, learned Addl. Chief Standing Counsel for State respondents.
¶2The petitioner, who is Pradhan of Village Atariya, has invoked the writ jurisdiction assailing the validity of the impugned order dated 30.6.2023 passed by respondent no.5-Block Development Officer, Dakor, Distt. Jalaun by which Gaushala/Cow Shed was directed to be transferred from Village Ataria and Chakjagdevpur to Piyaniranjanpur. Further prayer has been made for a direction to respondent no.5 to restore the Gaushala/Cow Shed in Village Atariya.
¶3On the matter being taken up today, learned Addl. Chief Standing Counsel has produced the letter dated 9.11.2023 sent by the the Chief Development Officer, Jalaun by which the order impugned was set aside and the Block Development Officer was directed to instruct the Gram Pradhan to remove the deficiency in Gaushala/Cow Shed at Village Ataria. As such it is contended that the relief claimed in the writ petition no more survives.
¶4Learned counsel for the petitioner submits that inspite of the order dated
9.11.2023, no action has been taken at the level of Block Development Officer.
¶5Considering the facts and circumstances of the case, without expressing any opinion on merits of the issue and with the consent, the writ petition stands disposed of asking respondent no.5-Block Development Officer to look into, examine and redress the grievance of the petitioner as per law and in view of the letter dated 9.11.2023 expeditiously and preferably within three weeks from the date of production of certified copy of this order but certainly after giving opportunity to all the stake holders in the matter.
