This writ petition has been filed with the prayer to quash the First Information Report, registered as Case Crime No. 30 of 2023, under Section 3(1) of the Uttar Pradesh Gangsters and Anti-social Activities (Prevention) Act, 1986, Police Station Unj, District Bhadohi. In view of the fact that petitioner has a criminal history of 16 cases and is implicated in several cases of theft and recovery of stolen articles, we do not find any good ground to quash the impugned FIR lodged against him under the Gangsters Act. Since, prima facie, allegations with regard to commissioning of cognizable offence are disclosed, the prayer made to quash the First Information Report is, therefore, declined, leaving all factual issues open to be determined at the stage of investigation/trial.
