¶1Heard learned counsel appearing for the petitioner, learned Standing Counsel appearing for the Respondents No. 1 & 2 and Mr. B.P. Singh Kachhawah, learned counsel appearing for the Respondents No. 3 & 4.

¶2Learned counsel appearing for the petitioner has submitted that her husband Mr. Arvind Kumar while working on the post of Assistant Teacher died on 02.10.2010. It has further been submitted that till date death cum retirement gratuity and family pension has not been paid to the petitioner.

¶3Mr. B.P. Singh Kachhawah, learned counsel appearing for the District Basic Education Officer, Etah on the basis of instructions received vide letter dated 04.12.2023 has submitted that time and again petitioner has been directed to complete the papers required for grant of family pension but till date she has not completed the requisite paper formality and therefore, petitioner's matter has not been decided.

¶4Mr. B.P. Singh Kachhawah has further submitted that if petitioner completes all the paper formalities within 15 days from today, the District Basic Education Officer, Etah shall pass the necessary orders in respect of the dues of the petitioner i.e. death cum retirement gratuity and family pension within two months thereafter.

¶5Learned counsel appearing for the petitioner undertakes that petitioner shall complete all the paper formalities in the office of District Basic Education Officer, Etah within three weeks from today.

¶6In view of the aforesaid reasons, this writ petition is finally disposed of with a direction to petitioner to complete all the paper formalities related to payment of death cum retirement gratuity and family pension within three weeks from today and if formalities are completed, District Basic Education Officer, Etah is directed to take final decision in the matter within two months thereafter.

¶7Direction is also issued to Respondents No. 2 & 4 to cooperate with the District Basic Education Officer, Etah in respect of the decision in the petitioner's matter. Order Date :- 7.12.2023 Gaurav High Court of Judicature at Allahabad
