¶1Supplementary affidavit and the instructions filed today be kept on record.
¶2Learned counsel for the Electricity Department shall supply a copy of the instructions to the learned counsel for the petitioner.
¶3It has been informed by the counsel for the Electricity Department that the permanent disconnection of the petitioner's connection was done on 08.11.2021. The petitioner as per demands paid Rs.2,20,000/- on 23.11.2016, Rs.5,000/- on 06.11.2017, Rs.40,000/- on 21.11.2023 and Rs.1,36, 518/- on 05.12.2023.
¶4Learned counsel for the petitioner, however, states that after permanent disconnection, no bill could have been paid and that the earlier bills were erroneously sent.
¶5We therefore consider it appropriate that the petitioner may represent his case before the concerned Executive Engineer under Clause 6.5 of the U.P. Electricity Supply Code and make his complaint there itself. It is therefore being provided that if the petitioner makes an application within a period of 15 days from today under Clause 6.5 of the U.P. Electricity Supply Code before the concerned Executive Engineer then the same shall be decided within a period of one month thereafter by the Executive Engineer.
¶6For a period of two months or till a decision is taken, whichever is earlier no coercive action shall be taken against the petitioner.
¶7With the aforesaid directions, the writ petition is disposed of. Order Date :- 7.12.2023 Prajapati (Syed Qamar Hasan Rizvi,J) (Siddhartha Varma, J) High Court of Judicature at Allahabad
