¶1Heard learned counsel for the petitioners and perused the record.

¶2It is argued by learned counsel for the petitioners that during the pendency of the Original Suit No.830 of 2019 ((Smt. Sharda Paliwal and another Vs. Smt. Kiran Devi and another), an application under Order 39 Rule 7 C.P.C. read with Section 151 C.P.C. has been filed by the petitioners in the Court of Civil Judge (Senior Division) Aligarh on 25.10.2023. It is argued that the Court below has fixed the date on 25.10.2023 and the matter is still pending. It is argued that the next date fixed in the matter was

20.11.2023. It is argued that considerable time has already been lapsed but till date no final decision has been taken in the matter.

¶5In the facts and circumstances of the case, the present petition is disposed of directing the court concerned to decide the aforesaid application, if possible, on the next date fixed in the matter. If on account of any reason, the same could not be decided, the aforesaid application be decided within a period of three weeks and without granting any unnecessary adjournment to any of the parties, if there is no legal impediment.
