¶1The writ petitioner herein has filed the present writ petition seeking Mandamus directing the respondent to reinstate the petitioner in service on Class-IV post in respondent no. 4 institution, Kashi Naresh Post Graduate College, Gyanpur Sant Ravidas Nagar, Bhadoi.

¶2Learned counsel for the writ petitioner relies upon an award passed in Adjudication Case No. 1 of 2014 passed on 20.1.2022. It has come on record and is apparent from page 68 of the paper book that proceeding under Section 6(h)(1) of the U.P. Industrial Dispute Act, 1947 has been initiated by the petitioner and further from page 70, it is also apparent that the institution in question has preferred Writ-A No. 35568 of 2022 questioning the award.

¶3Conflicted with the question regarding maintainability of the writ petition, learned counsel for the petitioner could not satisfy the Court on any ground.

¶4Accordingly, the writ petition is consigned to record, leaving it open to the writ petitioner to pursue the remedy which has already availed by it. Order Date :- 7.12.2023 S.A. High Court of Judicature at Allahabad
