Judgment

Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 16606 of 2023 Petitioner :- Geeta Devi @ Neeta Devi And 2 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Kumar Beenu Singh Counsel for Respondent :- G.A.,Ranjeet Kumar Mishra Hon'ble Anjani Kumar Mishra,J. Hon'ble Mohd. Azhar Husain Idrisi,J.

¶1Heard learned counsel for the petitioner, learned counsel for the first informant and learned A.G.A. for the State.

¶2The instant writ petition seeks quashing of the FIR dated

24.9.2023 giving rise to Case Crime No. 359 of 202, under Sections 306, 498-A, 304-B IPC and Section 3/4 Dowry Prohibition Act, Police Station Hathras Gate, District Hathras.

¶3Since the offence alleged in the impugned FIR is also for the offence under Section 304-B IPC which is a heinous offence, this Court is not inclined to entertain the petition.

¶4Moreover, the allegations made in the First Information Report clearly disclose commission of cognizable offences and the allegations are serious in nature. Therefore, prayer of the petitioner to quash the First Information Report is completely misconceived and is rejected.

¶5The writ petition is therefore dismissed, without prejudice to the right of the petitioners to apply for bail/anticipatory bail. Order Date :- 7.12.2023 M. Tarik High Court of Judicature at Allahabad
