¶1The petitioner has prayed for quashing of auction notice dated 4.04.2023 pertaining to the land in question.

¶2On 21.09.2023, the following order was passed:- "1. The Principal Secretary Awas will file his personal affidavit and apprise the Court as to whether any decision has been taken by the State Government in compliance of the order dated 02.12.2016 passed in Writ-C No. 57118 of 2016(Smt. Veena Gupta & Another vs. State of U.P. & 2 Others).

¶2Put up as fresh on 06.10.2023.

¶3Sri Rajiv Gupta, learned Additional Chief Standing Counsel will communicate the instant order to the concerned official for due compliance."

¶3Counsel for the petitioner states that after the passing of the aforesaid order, the State Government has taken decision on 4.10.2023. He prays for permission to withdraw the instant petition with liberty to the petitioner to challenge the order dated 4.10.2023.

¶4Sri Rajeev Gupta, learned Additional Chief Standing Counsel appearing for the State respondents has no objection to the same.
