¶1Heard learned counsel for the applicant and Sri N.K. Sharma learned A.G.A. for the State.

¶2This is an application for cancellation of bail.

¶3The opposite party no.2 was released on bail by the learned Sessions Judge, Gorakhpur vide order dated 20.9.2023 passed in Bail Application No.5653 of 2023.

¶4No violation of conditions or misuse of liberty of bail has been established from the bail cancellation application.

¶5Arguments have been advanced against the order granting bail. It appears that the instant application is essentially an application for re-hearing or review of the order granting bail. This Court is neither sitting in appeal nor in review jurisdiction.

¶6No case for bail cancellation is made out. However, in case any instance of threatening or influencing the witnesses is brought to the notice of the learned trial court, the learned trial court shall take appropriate measure under the Witness Protection Scheme, 2018.
