Judgment

Court No. - 21 Case :- WRIT - C No. - 39465 of 2023 Petitioner :- Manmohan Singh And 8 Others Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Santosh Kumar Rai Counsel for Respondent :- C.S.C.,Pawan Kumar Mishra,Suresh C. Dwivedi Hon'ble Manoj Kumar Gupta,Acting Chief Justice Hon'ble Donadi Ramesh,J.

¶1Heard Sri Santosh Kumar Rai, learned counsel for the petitioners, Sri Rajiv Gupta, learned Additional Chief Standing Counsel for the State-respondents, Sri Suresh C. Dwivedi, learned counsel for respondent no.4, Sri Abhishek Kumar, learned counsel for respondent no.5 and Sri Pawan Kumar Mishra, learned counsel for respondent no.6.

¶2The prayer made in the instant petition is for a direction to the respondents to pay compensation to the petitioners in respect of the land, which was taken over by the respondents in pursuance of a sale-deed executed in their favour.

¶3On 17.11.2023, following order was passed: "1. It is surprising that despite the respondents having obtained sale-deed from the petitioners for sale of their land for purposes of constructions of a highway, the sale consideration mentioned therein has not been paid to the petitioners so far.

¶2Now, it is sought to be contended that there is some dispute raised by private persons in respect of title to the said land.

¶3Once the respondents have obtained sale-deed from the petitioners, it is inconceivable how the sale consideration amount is being withheld by them.

¶4We call upon District Magistrate, Ballia (respondent No. 2), Chief Executive Officer, U.P. Expressways Industrial Development Authority, Lucknow (respondent No. 4), Project Director, National Highway Authority of India (respondent No. 6) to file their personal affidavits and explain their stand and the time frame for making the payment.

¶5Put up on 8 December 2023, as a fresh case."

¶4On matter being taken up today, learned counsel for the petitioners admits that the sale-consideration amount has been paid to the petitioners.

¶5Personal affidavit of respondent no.2 filed today also takes the same stand. Therefore, nothing further survives for consideration in the matter.

¶6The petition stands disposed of accordingly. (Donadi Ramesh, J.) (Manoj Kumar Gupta, ACJ.) Order Date :- 8.12.2023 Noman High Court of Judicature at Allahabad
