¶1The instructions filed today be kept on record.

¶2The petitioner had got an electricity connection in the year 2014 but electricity supply could not be connected and bill was generated. Thereafter, the petitioner had approached the Consumer Redressal Forum, which on 19.11.2020 passed an order saying that the bill which was generated by the electricity department for Rs.55,655/- was cancelled. The petitioner thereafter, was waiting for the electricity connection. Instead, again on 23.03.2023 another bill was generated.

¶3Contention of the learned counsel for the petitioner is that when actually the petitioner was not given any connection then the bill could not be generated.

¶4Learned counsel for the electricity department was required to take instructions in the matter. He enquired from the electricity department and has produced the communication dated

07.12.2023, stating that the bill which was further generated, had been cancelled.

¶5Learned counsel for the electricity department states that now no bill is due against the petitioner, therefore, he was not to make payment towards any bill.

¶6Learned counsel for the petitioner further submits that petitioner had got electricity connection in the year 2014 but still there is no electricity supply. He submits that he is ready to pay the cost of electricity poles and wires which were required to be installed for giving electricity supply to the petitioner.

¶7Under such circumstances, vis-a-vis the recovery no further order is required to be passed. However, as and when as per the prevailing price, the petitioner deposits money for the electricity poles and the wires, then he be given the electricity supply.

¶8With the above observations, the writ petition is disposed of.

¶9This order was passed in the presence of Sri Rakesh Kumar Mishra, Advocate, holding brief of Sri Narendra Kumar Tiwari, learned counsel for the Electricity Department. Order Date :- 8.12.2023 Prajapati (Syed Qamar Hasan Rizvi,J) (Siddhartha Varma,J) High Court of Judicature at Allahabad
