¶1Case called out. None responds for the petitioner.

¶2This petition has been filed with a prayer to issue an order or direction to the court concerned for expediting hearing of an application filed under section 125 Cr.P.C. filed by his wife for obtaining maintenance for herself and her daughter.

¶3I went through the material on record, which includes the order sheets drawn by the concerned court in the above case. From the perusal of the papers, it is clear that the application under section 125 Cr.P.C. was filed in the year 2020 and is pending since last about three years. The order sheets dated 7.5.2022, 27.07.2022, 23.08.2023, 28.09.2022 and several others indicate that the accused petitioner has been indulging in delaying tactics.

¶4In view of the above observations, the learned trial court is directed to expedite the hearing and decide the application moved under section 125 Cr.P.C. preferably within a period of three months from the date of production of certified copy of the order without granting any unnecessary adjournment to the parties.

¶5Let a copy of the order be notified to the court concerned.
